Des Senateurs attaquent Jovenel en justice

Au nom de la séparation des 3 pouvoirs et suite à la requête conjointe des Sénateurs Jean Renel Sénatus, Jean Marie Junior Salomon et Dieupie Chérubin pour obtenir justice suite au tweet posté sur le compte officiel du Président proclamant la caducité du parlement et le renvoi de deux tiers du Sénat, Jovenel Moïse et son conseiller, Judes Charles Faustin viennent d’être cités comme prévenus au Tribunal de Première Instance de Port-au-Prince, siégeant en ses attributions correctionnelles, dans le délai de trois (3) jours franc, dès 10 heures Am, par devant le Doyen ou tout autre juge par lui désigné pour connaître de l’espace et à suivre au besoin toutes les audiences subséquentes toujours les mêmes jours, heures et attributions jusqu’au jugement définitif de l’instance.

Ces parlementaires accusent Jovenel Moïse de violation de la constitution en son article 95, du décret électoral de 2015 en son article 50.3 et d’avoir utilisé son pouvoir pour écourter leur mandat de six ans. Ils assurent à tous que les grands décideurs du temple de thémis appliqueront la loi et Jovenel Moïse sera poursuivi et condamné pour abus de fonction, Selon l’article 28 du code pénal haïtien.

« Attendu que le Président n’a nul droit de prolonger le mandat d’un Sénateur dont la durée est fixée par la loi encore moins de déclarer caduc un Sénat fonctionnel avec ses 19 membres en exercice;

Attendu qu’en agissant de la sorte, le Président de la République, Agent Public exerçant un mandat ne fait qu’entraîner, comme auteur, les allégations de son complice Jude Charles Faustin et cimmis un abus de fonction, fait réprimé par l’article 5.5 de la loi sur la prévention et la répression de la corruption qui dispose : » l’abus de fonction est le fait pour un agent d’abuser de ses fonctions ou de son poste, c’est-à-dire d’accomplir, dans l’exercice de ses fonctions, un acte de violation des lois afin d’obtenir un avantage indu pour lui-même, une autre personne ou entité.  »

Attendu que le prévenu et son complice seront condamnés à la peine prévue à l’article 5.5 de la loi de 2014 portant, prévention et la répression de la corruption. » Sont entre autres les causes et motifs inscrits insérés dans cette citation. Il faut rappeler que les journalistes Garry Pierre Paul Charles et Guerrier Dieuseul, et le numéro 1 du PHTK, Liné Balthazar sont aussi cités à titre de témoins.
