Coup de théâtre dans l’affaire Ti Wil des Gonaïves: Libération ordonnée, mais entravée par des rebondissements judiciaires.-

Dans un épisode surprenant du dossier judiciaire impliquant Wilfort Ferdinand, plus connu sous le nom de “Ti Wil”, le juge Marc Arthur L. Bien-Aimé a émis une ordonnance de libération le mardi 12 décembre. Cette décision fait suite à une action en habeas corpus entreprise par ses avocats Néhémy Joseph et Hugo Chevalier. Cependant, alors que les avocats étaient au commissariat pour assurer la libération conformément à l’ordre du commissaire général des Gonaïves, un huissier est intervenu avec un mandat de dépôt émis par le juge d’instruction Guimy Thélot, entravant ainsi l’exécution de la décision du juge Bien-Aimé.

L’huissier a invoqué le mandat de dépôt, émis par le juge Thélot, ajoutant une couche de complexité à cette affaire déjà délicate. Les avocats, dénonçant cette manœuvre, ont exprimé leur préoccupation quant à l’état de santé de “Ti Wil”, affirmant que celui-ci s’était détérioré récemment. Me Chevalier a insisté sur la nécessité de transférer rapidement son client dans un centre hospitalier de niveau 3.

Malgré l’ordonnance de libération, “Ti Wil” reste actuellement menotté à son lit d’hôpital. Les charges qui pèsent contre lui comprennent la « détention illégale d’arme à feu, association de malfaiteurs et destruction de biens publics ». Cette situation crée un climat d’incertitude autour du dénouement de cette affaire et soulève des questions sur l’indépendance du système judiciaire dans cette région.
