2 min de lectureLe Centre d’analyse et de recherche en droits de l’homme (CARDH) a demandé au Doyen du tribunal de première instance de Port-au-Prince, juge Chavannes Etienne, de désigner un nouveau juge d’instruction pour l’enquête sur l’assassinat du président haïtien Jovenel Moïse. Le juge Walter Wesser Voltaire, qui avait été désigné pour l’enquête en mai 2022, avait jusqu’au 30 août 2022 pour mener l’instruction, conformément à la loi haïtienne. Le CARDH a souligné que ce délai avait expiré et qu’un autre juge devait être désigné conformément à l’article 7 de la loi du 26 juillet 1979 sur l’appel pénal et à l’ordonnance du 18 janvier 2022 du juge Bernard Saint-Vil, ancien doyen du tribunal de première instance de Port-au-Prince.
Le juge Voltaire avait été nommé pour remplacer le juge Merlan Belabre, dont le mandat de juge d’instruction était arrivé à terme le 25 avril 2022. Le CARDH avait déjà adressé une correspondance au doyen Saint-Vil le 23 août 2022 pour lui rappeler que le délai d’instruction du juge Voltaire arrivait à terme et qu’un autre juge devait être désigné conformément à la loi.
Selon l’ordonnance du juge Saint-Vil du 18 janvier 2022, «l’article 7 de la loi du 26 juillet 1979 sur l’appel pénal accorde au Magistrat instructeur saisi d’un dossier un délai de trois mois sous peine de prise à partie contre ledit magistrat, soit deux mois pour la conduite de l’enquête et un mois pour la rédaction de l’ordonnance de clôture». Le juge Saint-Vil avait rejeté la demande de prorogation produite par le juge Garry Orélien et l’avait dessaisi de l’affaire.
Le CARDH a donc demandé au nouveau Doyen du tribunal de première instance de Port-au-Prince de désigner un nouveau juge pour la poursuite de l’instruction. L’assassinat du président Moïse a eu lieu en juillet 2021, mais l’enquête a été entravée par des retards et des difficultés politiques et sécuritaires en Haïti. Le CARDH a appelé à la poursuite de l’enquête dans le respect de la loi et de la justice, afin que les responsables de l’assassinat du président Moïse soient traduits en justice.
