2 min de lectureLe Centre d’analyse et de recherche en droits de l’homme (CARDH) apprécie la désignation de M. William O’Neill, un avocat spécialisé dans les droits de l’homme, pour le poste d’Expert indépendant sur la situation des droits de l’homme en Haïti.
Selon CARDH, l’Expert indépendant est un mécanisme permettant au Conseil des droits de l’homme de s’informer régulièrement de la situation des droits de l’homme dans un pays. La nomination d’un Expert pour un pays signifie, en général, que la situation des droits de l’homme y est préoccupante. Cela s’expliquerait par la théorie volontariste qui constitue le pilier du droit international en général. En vertu de la Résolution A/HRC/52/L.17/Rev.1, le nouvel Expert sur la situation des droits de l’homme en Haïti est chargé de « suivre, avec l’assistance du Haut-Commissariat, et en collaboration avec le Bureau intégré des Nations Unies en Haïti (BINUH), l’évolution de la situation des droits de l’homme ».
En outre, il devra donner une attention particulière à la situation des enfants et de la traite des êtres humains, et veillera à intégrer une perspective de genre. L’Expert fournira également des conseils et une assistance technique au gouvernement haïtien, aux institutions nationales des droits de l’homme et aux organisations de la société civile, et les aidera dans leurs efforts pour assurer le respect, la promotion et la protection des droits de l’homme.
CARDH souligne que bien que la désignation d’un Expert indépendant soit importante, la garantie du respect et de la jouissance des droits de l’homme incombe à l’État et à la coopération internationale.
La Résolution A/HRC/52/L.17/Rev.1 demande également au Haut-Commissariat de fournir au gouvernement haïtien une assistance technique et un soutien pour le renforcement des capacités dans la promotion et la protection des droits de l’homme, en particulier pour la justice haïtienne, les forces de sécurité et l’administration pénitentiaire.
