On constate la dépendance du pouvoir judiciaire tant aux textes appliqués pour les magistrats et l'organisation judiciaire sont au mépris des respects des prescrits constitutionnels , des mécanismes relatifs au processus de la nomination des magistrats dans le Pouvoir Judiciaire en Haïti.

OBSERVATOIRE HAÏTIEN POUR LE DROIT ET LA LIBERTÉ DE LA LIBERTÉ

L’Etat haïtien est constitué par l’existence de trois pouvoirs publics: le législatif, l’exécutif et le judiciaire

Les parlementaires et le président de la République sont élus par le peuple au sufrage universel, tandis que les membres du pouvoir judiciaire, magistrats assis et commissaires du gouvernement sont choisis, sont nommés par l’Exécutif. Il faut quand même rappeler que les juges à la Cour de cassation sont élus au second degré par les sénateurs pour un mandat de dix ans.

Historiquement, les Constitutions haïtiennes de 1843,1846,1860,1867,1887,1888,1889 ont toutes laissé une place de choix au pouvoir judiciaire.

En effet, la Constitution de 1935,
a consacré au pouvoir judiciaire en statut de corps judiciaire.


Quant à la Constitution de 1946 la notion de Pouvoir Judiciaire fut reconsacrée et les Constitutions successives de 1950, 1957, 1971 , 1983 et 1987 l’ont retenu dans des dispositions traitant de prétendues vertus démocratiques, de l’existence de trois (3) Pouvoirs Publics et de leur séparation expliqués dans de multiples textes philosophiques ou politiques.

Cependant, le Décret du 22 août 1995 publié sous présidence provisoire de Me Boniface Alexandre, revient à l’appellation de la Constitution de 1935 et réduit le Pouvoir Judiciaire à une simple expression de  » Corps Judiciaire  » en prétendant faire croire que le Pouvoir Judiciaire est indépendant des deux ( 2) autres organes de l’État et dit clairement que cette prétendue indépendance serait garantie par le Président de la République ( art .2 du décret du 22 août 1995 ).

D’un autre côté, la loi du 13 novembre 2007 créant le Conseil Supérieur du Pouvoir Judiciaire (CSPJ).


La loi du 27 Novembre 2007, réglementant l’exercice du pouvoir Judiciaire et sa Composition de la Magistrature encore avec les bras politiques du pouvoir l’exécutif dans le choix et la nomination du premier grade de la magistrature qui est le président de la cour de Cassation

On constate la dépendance du pouvoir judiciaire tant aux textes appliqués pour les magistrats et l’organisation judiciaire sont au mépris des respects des prescrits constitutionnels , des mécanismes relatifs au processus de la nomination des magistrats dans le Pouvoir Judiciaire en Haïti.

Le ministère de la justice (Exécutif) a pour attribution de contrôler les activités des Cours, Tribunaux et Parquets. Néanmoins les membres du Conseil Supérieur du Pouvoir Judiciaire (CSPJ) doivent être nommés par arrêté présidentiel et le Choix du président de la Cour de Cassation, l’Officier ministériel et les commissaires du Gouvernement au sein du pouvoir judiciaire sont exclusivement les produits politiques du pouvoir exécutif dont les magistrats de l’ordre Judiciaire sont sous la dépendance.


Ce pouvoir politique détient dans la pratique le contrôle totalitaire des institutions judiciaires et les disciplines des cours, Tribunaux et Parquets en Haïti.

Un pouvoir ou une institution indépendant(e) doit pouvoir gérer son indépendance administrative, financière entre autres. C’est le contraire pour le pouvoir judiciaire en Haïti, c’est l’exécutif qui contrôle, gère et administre le budget alloué au pouvoir judiciaire par le biais du ministère de la justice, en Haïti.

Le pouvoir exécutif à travers ses représentants dans les parquets près les tribunaux de Premières Instances de la République d’Haïti est le principal responsable de la surpopulation carcérale dans les prisons civiles en Haïti, car ces derniers au premier plan des responsables de la prison civile de leurs juridictions respectives, un commissaire du Gouvernement a plus de pouvoir par le biais de son exéquatur qu’une décision de justice d’un tribunal, dont le mandement exécutoire est insuffisant à lui-même dans la pratique pour porter les responsables des Commissariats et les prisons Civiles d’Haïti pour remettre en liberté ‘une personne écrouée.

Fort de ce qui précède, il est à conclure que les pouvoirs exécutif, législatif et judiciaire doivent être indépendants en Haïti. La liberté des gens serait une réalité et cesserait d’être ilusoire.
Cela garantirait l’établissement de l’Etat de droit et le droit d’accès à un juge
