Le fondateur panaméen du cabinet Mossack Fonseca, qui était jugé pour le scandale financier des Panama Papers en 2016, est mort ce jeudi 9 mai. La cause de son décès n’est pas connue.
Il était l’un des dirigeants du cabinet d’avocats au cœur des «Panama Papers». Ramon Fonseca est mort alors qu’il attendait son jugement dans le cadre de ce scandale mondial qui avait éclaté en 2016, a annoncé son avocate ce jeudi 9 mai, sans préciser la cause du décès. L’avocat panaméen «était hospitalisé, c’est pourquoi il n’a pas assisté au procès», qui s’était ouvert le 8 avril et n’avait pas encore délivré de jugement, a affirmé Guillermina McDonald, une avocate de l’ancienne société au centre du scandale qui a révélé comment des célébrités du monde entier ont caché de l’argent au fisc. Ramon Fonseca, 71 ans, est mort dans un hôpital de la capitale du pays d’Amérique centrale.

Lors du procès, qui s’est achevé le 19 avril, la peine maximale pour blanchiment d’argent — douze ans de prison — avait été requise à l’encontre de Ramon Fonseca et Jürgen Mossack, les deux fondateurs du cabinet d’avocats Mossack Fonseca. Le tribunal doit rendre son jugement dans un délai de trente jours.
L’affaire a éclaté en 2016 après la publication d’une enquête, connue sous le nom de «Panama Papers», menée par le Consortium international de journalistes d’investigation (CIJI). Basée sur la fuite de 11,5 millions de documents provenant de l’étude Mossack Fonseca, elle a révélé que des chefs d’Etat et de gouvernement, des responsables politiques de premier planet des personnalités des finances, des sports et du monde artistique ont caché au fisc des propriétés, des entreprises, des capitaux et des bénéfices.
A cette fin, ils ont créé des sociétés opaques, par l’intermédiaire du cabinet panaméen, pour ouvrir des comptes bancaires et créer des sociétés écrans dans plusieurs pays, afin de dissimuler de l’argent, provenant dans certains cas d’activités illégales, selon l’enquête du consortium.
Parmi les personnalités mentionnées figurent, entre beaucoup d’autres, les anciens chefs de gouvernement d’Islande Sigmundur David Gunnlaugsson, du Pakistan Nawaz Sharif et du Royaume-Uni David Cameron (actuel chef de la diplomatie britannique), l’ex-président argentin Mauricio Macri, ainsi que la star du football Lionel Messi et le cinéaste espagnol Pedro Almodovar.
Le scandale a entraîné la fermeture du cabinet Mossack Fonseca et l’image du petit pays d’Amérique centrale s’en est trouvée gravement affectée.
Paiement de commissions et escroquerie
L’accusation reproche aux avocats Mossack et Fonseca d’avoir facilité, par l’intermédiaire de leur cabinet d’avocats, la création de sociétés opaques dans lesquelles des cadres de la multinationale allemande Siemens ont déposé des millions d’euros en dehors des comptes réels de l’entreprise. Cette «caisse B» aurait été utilisée pour y dissimuler de l’argent lié au paiement de commissions. Le cabinet panaméen, selon l’accusation, a également été utilisé pour entreposer de l’argent provenant d’une vaste escroquerie en Argentine.
«Vraiment, il y a eu une grande injustice […] Je répète que mon associé et toutes les personnes qui ont travaillé avec moi ont été des personnes sérieuses, honnêtes et correctes», s’était défendu Jürgen Mossack lors de sa plaidoirie le 19 avril.
L’affaire a été portée au cinéma. Ramon Fonseca, qui a écrit plusieurs romans, a été interprété par l’acteur espagnol Antonio Banderas dans le film The Laundromat : L’Affaire des Panama Papers» (2019), avec également l’actrice américaine Meryl Streep. Mossack a été interprété par Gary Oldman dans ce film réalisé par Steven Soderbergh.
