Plus de neuf mois après l’assassinat du président Jovenel Moïse, chez lui, le 7 juillet 2021, l’instruction fait du surplace, contraste avec les engagements pris par les plus hautes autorités haïtiennes de fournir les moyens à la justice de faire son travail. L’administration Biden, quant à elle, s’intéresse aux développements de l’enquête.
Alors que des juges d’instruction sont débarrassés du dossier comme une patate chaude – pour plusieurs raisons- , le président Joe Biden, dans le cadre du budget des États-Unis pour l’exercice en cours qui doit s’achever fin septembre 2022, a, dans le cadre de la « loi sur le développement, la responsabilité et la transparence institutionnelle en Haïti », signée le 15 septembre, à la section « 108, rapport sur l’assassinat du président Jovenel Moïse », instruit ses services de fournir des rapports sur l’enquête.
Les développements, les menaces et tout « acte d’intimidation à l’encontre des autorités haïtiennes chargées de l’application de la loi et des autorités judiciaires impliquées dans l’enquête sur l’assassinat du président Jovenel Moïse, incluant l’identification des personnes étrangères impliquées dans ces menaces et actes d’intimidation » intéressent aussi l’administration Biden. Plus loin, cette loi commande « une description de tout effort visant à interférer dans ou de saper l’indépendance et l’intégrité de l’enquête sur l’assassinat du président Jovenel Moïse ».
Les rapports demandés
Selon la section qui concerne Haïti, « au plus tard 90 jours après la date de promulgation de la présente loi, le secrétaire d’État, en coordination avec le ministre de la Justice (attorney general), le secrétaire à la Sécurité intérieure et le directeur de la Central Intelligence Agency, soumettra à la Commission des Relations étrangères du Sénat et à la Commission des Affaires étrangères de la Chambre des représentants un rapport sur l’assassinat, le 7 juillet 2021, du président d’Haïti Jovenel Moïse ».
« Au plus tard 180 jours après la présentation du rapport requis par la sous-section, le secrétaire d’État, en coordination avec le secrétaire à la Justice, le secrétaire à la Sécurité intérieure et le directeur de la Central Intelligence Agency (CIA), doit mettre à jour le rapport. Le directeur de la Central Intelligence Agency soumet à la commission des Relations étrangères du Sénat et à la commission des Affaires étrangères de la Chambre des représentants une version actualisée du rapport qui inclut tout développement significatif lié à l’assassinat du président Jovenel Moïse », peut-on lire dans cette loi qui spécifie les informations attendues. Le rapport exigé par la sous-section et le rapport requis par la sous-section doivent chacun inclure les éléments suivants : une description détaillée des événements ayant conduit à l’assassinat du président Jovenel Moïse et de l’enquête subséquente sur l’assassinat, y compris une description et une identification des dates clés et des noms des personnes étrangères liées à l’assassinat et à l’enquête sur l’assassinat ; une description du soutien des États-Unis aux efforts des autorités haïtiennes pour enquêter sur l’assassinat du président Jovenel Moïse », lit-on dans ce texte qui veut avoir une perspective sur les capacités de la justice haïtienne. « Une évaluation de l’indépendance et de la capacité des autorités haïtiennes à enquêter sur l’assassinat du président Jovenel Moïse, comprenant une analyse des avancées et des déficiences significatives de l’enquête », est demandée.
De l’implication d’étrangers, d’anciens employés du gouvernement américain
Cette loi exige « une description de l’implication dans l’assassinat du président Jovenel Moïse de toute personne étrangère précédemment employée par le gouvernement des États-Unis ou ayant servi d’entrepreneur ou d’informateur pour ce dernier. Une description et l’identification des étrangers impliqués dans l’exécution et la planification de l’assassinat du président Jovenel Moïse et une évaluation des intentions de ces personnes étrangères », peut-on lire dans le texte, qui stipule la forme des rapports à soumettre. Le rapport exigé par la sous-section (a) et le rapport mis à jour exigé par la sous-section (b) seront chacun soumis sous une forme non classifiée, mais chacun peut comporter une annexe classifiée. Le secrétaire d’État publie sur le site Internet public du département d’État la version non classifiée du rapport requis par la sous-section (a) au plus tard 15 jours après la date à laquelle le rapport est soumis en vertu de cette sous-section ; et la version non classifiée du rapport requis par la sous-section (b) au plus tard 15 jours après la date à laquelle le rapport est soumis en vertu de cette sous-section », selon ce texte, qui évoque aussi la nécessité d’un briefing sur ce dossier. « Le secrétaire d’État, en coordination avec le ministre de la Justice( attorney general) , le secrétaire à la Sécurité intérieure et le directeur de la Central Intelligence Agency, fait savoir la Commission des Relations extérieures du Sénat et la commission des Affaires étrangères de la Chambre des représentants du contenu du rapport requis par la sous-section (a) au plus tard 15 jours après la date à laquelle le rapport est soumis en vertu de cette sous-section; et sur le contenu du rapport exigé par la sous section (b) au plus tard 15 jours après la date à laquelle le rapport est soumis en vertu de cette sous-section », peut-on lire dans ce texte.
Contexte de l’intérêt de l’administration Biden aux développements de l’enquête
La signature de cette loi intervient à un moment où le juge d’instruction en charge de l’enquête, Merlan Belabre, s’était fendu, il y a quelques jours, d’un communiqué de presse pour exposer la non-réception du dossier et l’absence de mesures pour assurer sa sécurité et celle de sa famille. « Je constate que l’exécutif et le Conseil supérieur du pouvoir judiciaire (CSPJ) m’ont livré, avec ma famille, aux assassins et aux kidnappeurs. 10 jours après m’avoir confié le dossier, ils n’ont pris aucune disposition pour me le remettre physiquement ni pour assurer ma sécurité et celle de ma famille. Ma famille et moi, nous n’allons pas nous enfuir. L’Etat haïtien sera tenu pour responsable si quelque chose arrive à moi, à ma famille ou à mes collaborateurs », pouvait-on lire dans cette note de presse rédigée en créole et rendue publique le 13 mars dernier.
Au moins une quarantaine de suspects, dont des ex-militaires colombiens, des policiers de la sécurité présidentielle, un ex- sénateur, des civils sont incarcérés en Haïti, aux Etats-Unis, en Turquie, à la Jamaïque dans le cadre de ce dossier.
