États-Unis : la Cour suprême autorise l’administration Trump à retirer la protection contre l’expulsion à 350 000 Haïtiens

Washington – La Cour suprême des États-Unis a rendu, jeudi, une décision majeure en matière d’immigration en autorisant l’administration du président Donald Trump à mettre fin au Statut de protection temporaire (TPS) accordé à environ 350 000 ressortissants haïtiens, ainsi qu’à près de 6 000 Syriens.
Par six voix contre trois, les juges conservateurs de la plus haute juridiction américaine ont estimé que les décisions du pouvoir exécutif concernant le TPS ne relèvent pas du contrôle des tribunaux. Les trois juges progressistes se sont opposés à cette décision.
Créé pour protéger les ressortissants de pays frappés par des conflits armés, des catastrophes naturelles ou d’autres crises majeures, le TPS permet à ses bénéficiaires de vivre et de travailler légalement aux États-Unis tant que leur retour dans leur pays d’origine est jugé dangereux. Les Haïtiens en bénéficiaient depuis le séisme dévastateur de janvier 2010, tandis que les Syriens y avaient accès depuis le déclenchement de la guerre civile en 2012.
Cette décision s’inscrit dans la politique migratoire restrictive mise en œuvre par Donald Trump depuis son retour à la Maison-Blanche en janvier 2025. L’administration américaine soutient que le TPS a toujours été conçu comme une mesure exceptionnelle et temporaire, et non comme un mécanisme de résidence permanente.
Les défenseurs des droits des migrants dénoncent toutefois une décision aux conséquences potentiellement dramatiques. Selon Krish O’Mara Vignarajah, président de l’organisation Global Refuge, des centaines de milliers de familles ayant construit leur vie aux États-Unis, payé leurs impôts et contribué à l’économie américaine risquent désormais d’être expulsées vers des pays toujours confrontés à une grave instabilité.
Les organisations de défense des migrants rappellent que la Cour suprême n’a pas déclaré qu’Haïti ou la Syrie étaient désormais des pays sûrs. Elle a uniquement estimé que la question de l’octroi ou du retrait du TPS relevait du pouvoir exécutif et non du pouvoir judiciaire.
Au-delà des Haïtiens et des Syriens, cette décision pourrait créer un précédent susceptible d’affecter près de 1,3 million de bénéficiaires du TPS originaires de 17 pays actuellement protégés par ce dispositif.
Dans une autre décision rendue le même jour, la Cour suprême a également validé la possibilité pour l’administration Trump de refouler des demandeurs d’asile lorsque les autorités estiment que les points de passage entre les États-Unis et le Mexique sont saturés, renforçant ainsi davantage la politique migratoire du gouvernement américain.
