Le CSPJ demande des explications sur la prestation de serment de deux nouveaux délégués départementaux Jean Osner Amisial et de Serge Chéry.-

Le Conseil supérieur du pouvoir judiciaire (CSPJ) a écrit aux doyens du tribunal civil de première instance des Gonaïves et à celui des Cayes pour demander des explications sur la prestation de serment de Jean Osner Amisial et de Serge Chéry, respectivement délégué départemental de l’Artibonite et des Cayes, nommés par arrêté présidentiel à un moment où la rue réclame le départ du président Jovenel Moïse.
Contestés par des membres de la population de leurs régions respectives qui ont tout fait pour empêcher leur installation, ces délégués ont prêté serment clandestinement et à la va-vite dans les carrés du tribunal de première instance des Gonaïves et des Cayes.
Dans ladite correspondance adressée aux tribunaux de première instance des Cayes et des Gonaïves, le secrétaire technique du CSPJ demande aux doyens de ces tribunaux susmentionnés d’acheminer un rapport écrit au plus tard le vendredi 25 du mois en cours, par toutes voies appropriées expliquant les raisons de la prestation de serment du délégué départemental du Sud et de l’Artibonite en dehors des exigences de l’article 61 du décret du 22 août 1995 relatif à l’organisation judiciaire et de l’arrêté du 30 janvier.
« Vu la conjoncture découlant des soubresauts sociopolitiques avec toutes les conséquences désastreuses sur les vies et les biens enregistrées dans plusieurs points du territoire national impliquant plus que jamais le pouvoir judiciaire à se constituer le dernier rempart pour agir dans le sens des intérêts supérieurs de la nation haïtienne, je vous demande, sur les instructions du Conseil, d’acheminer un rapport écrit au plus tard le vendredi 25 du mois en cours, par toutes voies appropriées expliquant les raisons de la prestation de serment du délégué départemental en dehors des exigences de l’article 61 du décret du 22 août 1995 relatif à l’organisation judiciaire et de l’arrêté du 30 janvier », peut-on lire dans la correspondance signée de Me Jean-Robert Constant, secrétaire technique du CSPJ.
La prestation de serment de l’ancien maire des Cayes, Serge Chéry, a eu lieu lundi 14 octobre à 5h30 a.m. alors que la barrière principale du tribunal était encore fermée. Des avocats opposants avaient annoncé en conférence de presse qu’ils allaient attaquer en justice l’installation de M. Chéry.
Aux termes de l’article 61 : les audiences des cours et tribunaux sont publiques, sauf dans le cas où la loi, dans l’intérêt des bonnes mœurs et de l’ordre public, autoriserait le huis clos qui doit être prononcé par le jugement à l’audience. Les audiences durent au moins trois heures, de dix heures du matin à une heure de l’après-midi jusqu’à l’épuisement du rôle. Le prononcé des décisions a lieu entre une heure et deux heures de l’après-midi. Il pourra être, en cas de besoin, fixé des audiences dans l’après-midi, qui dureront également trois heures, soit de deux heures à cinq heures.
Notons que l’arrêté du 30 janvier 2015 a fixé l’horaire de travail dans l’administration publique. Selon l’article 2, les heures régulières de travail des agents publics s’étendent de huit heures du matin à quatre heures de l’après-midi.
