Haïti : la France suspend l’adoption internationale d’enfants mineurs sur fond d’insécurité

La France maintient la suspension des procédures d’adoption internationale concernant des enfants résidant en Haïti, en raison de la dégradation persistante de la situation sécuritaire dans le pays. Cette mesure, en vigueur depuis mars 2023, vise à garantir à la fois la sécurité des ressortissants et le respect des normes internationales encadrant ces procédures.
À l’origine de cette décision, les autorités françaises estiment que les conditions actuelles en Haïti ne permettent plus d’assurer la régularité des adoptions, notamment au regard de la Convention de La Haye du 29 mai 1993, qui encadre la protection des enfants et la coopération entre États en matière d’adoption internationale.
Concrètement, toutes les démarches engagées par des candidats résidant en France sont suspendues jusqu’à nouvel ordre, à l’exception des dossiers déjà avancés avant mars 2020. Cette mesure intervient dans un contexte marqué par une insécurité généralisée, qui complique non seulement les procédures administratives, mais aussi les déplacements sur le terrain.
Par ailleurs, la législation française a évolué. Depuis l’entrée en vigueur de la loi du 21 février 2022, les adoptions internationales par démarche individuelle sont désormais interdites. Les candidats doivent obligatoirement passer par des organismes autorisés, tels que l’Agence française de l’adoption ou des structures agréées.
En Haïti, le cadre juridique de l’adoption reste pourtant formalisé. Le processus est supervisé par l’Institut du Bien-Être Social et de Recherches, désigné comme autorité centrale. Il prévoit notamment des conditions strictes pour les adoptants, des critères précis concernant les enfants adoptables, ainsi qu’un encadrement judiciaire et administratif rigoureux.
Cependant, dans le contexte actuel, ces mécanismes sont fortement fragilisés. L’insécurité et les difficultés institutionnelles rendent difficile le bon déroulement des procédures, alimentant les inquiétudes sur les risques de dérives ou d’irrégularités.
Avant la suspension, les démarches d’adoption impliquaient plusieurs étapes complexes, allant de l’agrément en France à l’apparentement en Haïti, en passant par une phase de familiarisation obligatoire et une validation judiciaire. Une fois l’adoption prononcée, les autorités haïtiennes délivraient un certificat de conformité permettant la reconnaissance de la décision à l’international.
À ce stade, aucune date de reprise des adoptions internationales n’a été annoncée. Les autorités françaises recommandent par ailleurs la plus grande prudence aux candidats, notamment en raison des conditions de sécurité dégradées en Haïti.
La suspension de ces procédures illustre, une nouvelle fois, l’impact direct de la crise sécuritaire et institutionnelle sur les dispositifs de coopération internationale, au détriment des enfants et des familles concernés.

Star reported a 10 per cent drop in revenue for Treasury
