Selon des données de l’Agence des services frontaliers obtenues par TVA Nouvelles, en 2017, il y a eu 434 renvois de demandeurs d’asile d’origine haïtienne. En 2018, il y a eu jusqu’à présent 67 expulsions, portant le total à 501.
Les migrants ont été renvoyés dans leur pays d’origine et non aux États-Unis, pays par lequel ils ont transité avant d’arriver au Canada. Une fois qu’ils reçoivent leur avis d’expulsion, ils demeurent pour la majorité en liberté, mais ils doivent respecter la date de renvoi et se présenter à l’aéroport.
Si l’Agence des services frontaliers décèle un risque de fuite, cela peut constituer un motif de détention jusqu’au renvoi. Moins de 1% des demandeurs sont détenus avant ou après la décision.
Par ailleurs, les demandeurs d’asile renvoyés vont pour la plupart payer eux-mêmes leur billet de retour.
«Si [la personne] n’en a pas les moyens, c’est l’Agence des services frontaliers qui va payer», explique l’avocat spécialisé en immigration, Me Éric Taillefer.
«Par contre, il y a une conséquence à ça. Si la personne veut revenir un jour au Canada, que ce soit comme résident permanent, comme étudiant ou comme travailleur, elle va devoir payer des frais administratifs de 1500 $ par billet que l’Agence va avoir payé.»
De plus, les demandeurs d’asile renvoyés qui voudraient revenir au Canada devront payer des frais de 400 $ lorsqu’ils présenteront une demande d’autorisation pour revenir au Canada.
Samedi, quelques membres de la communauté haïtienne de Montréal avaient manifesté devant les bureaux de l’Agence des services frontaliers, au centre-ville, pour réclamer l’arrêt des expulsions.
