Gouvernance judiciaire et répression de la drogue en Haïti en temps de crise socio-politique et sécuritaire de 2014 à 2023 : Un rapport de l’Organisation des Citoyens pour une Nouvelle Haïti (OCNH)

La lutte contre le trafic de drogue en Haïti au cours des neuf dernières années a été marquée par des défis majeurs, selon une évaluation approfondie de l’Organisation des Citoyens pour une Nouvelle Haïti (OCNH). Malgré la présence de structures telles que la Brigade de Lutte contre le Trafic de Stupéfiants (BLTS) et la Commission Nationale de Lutte contre la Drogue (CONALD), les résultats restent insuffisants et largement incohérents avec l’ampleur du problème.
Les données recueillies révèlent une réalité alarmante : la plupart des dossiers liés à la drogue n’aboutissent pas à des condamnations significatives. Des obstacles systémiques au sein de l’appareil judiciaire, tels que la corruption et l’ingérence politique, entravent sérieusement les efforts pour combattre ce fléau. L’absence de politique pénale claire et la faiblesse des capacités institutionnelles sont également des facteurs critiques.
En effet, selon une enquête de l’OCNH auprès des magistrats haïtiens, une majorité écrasante a signalé des lacunes dans la spécialisation et la connaissance des lois relatives à la drogue. Cette lacune de compétence compromet non seulement le traitement efficace des affaires, mais aussi la crédibilité du système judiciaire dans son ensemble.
La crise socio-politique et sécuritaire qui a secoué Haïti pendant cette période a exacerbé la situation. L’instabilité politique a non seulement affaibli les institutions mais a également facilité l’ascension des groupes armés qui ont pris une part croissante dans le trafic de drogue. Ces groupes, souvent mieux armés que les forces de l’ordre, ont transformé certaines zones du pays en bastions de trafic, défiant ainsi l’autorité de l’État et sapant l’état de droit.
Les statistiques sur les saisies de drogue, bien que disponibles, sont loin de refléter l’étendue réelle du problème. Les opérations de la BLTS, censées être des piliers de la lutte contre le trafic de drogue, manquent souvent de transparence et de résultats tangibles. Les rapports publics sur leurs activités sont rares, ce qui soulève des questions sur l’efficacité et l’intégrité de ces institutions.
Dans ce contexte difficile, la population haïtienne subit les conséquences désastreuses du trafic de drogue : non seulement il s’agit d’un problème de santé publique mais aussi d’une menace grave pour la sécurité nationale. Les trafiquants, souvent liés à des réseaux internationaux, profitent de la vulnérabilité structurelle du pays pour opérer en toute impunité, mettant ainsi en péril le développement social et économique.
Pour surmonter ces défis, l’OCNH recommande une série de mesures urgentes. Celles-ci incluent le renforcement des capacités institutionnelles et opérationnelles du système judiciaire, la lutte contre la corruption à tous les niveaux, et l’amélioration de la coopération internationale pour combattre le trafic de drogue transnational.
La crise de gouvernance judiciaire en Haïti, exacerbée par la crise socio-politique et sécuritaire, requiert une action immédiate et concertée.
